Terms And Conditions Of Sale

  1. The Purchaser’s attention is drawn to the Trade Practices Act and sale of goods legislation (“Consumer Protection Legislation”) under which certain terms are implied to contracts for supply of goods; nothing in these terms or trade detracts from any non-excludable rights the Purchaser has under such legislation.
  2. The prices quoted in this document supersede all previous prices that may have been quoted. Prices quoted are subject to change without notice.
  3. For account customers, payment is due not later than 30 days from statement date, in every case. Credit facilities will be withdrawn from any customer whose account is overdue until such account is settled.
  4. The delivery records of Burleigh Tiles Pty Ltd shall be prima facie proof of delivery of the goods and of quantity and the description stated therein in good order and condition to the purchaser and the purchaser’s receipt therefor in the same condition notwithstanding the absence of any representative of the purchaser present at the premises of Burleigh Tiles Pty Ltd upon such delivery.
  5. Goods ordered by customers may be temporarily, stored at Burleigh Tiles Pty Ltd only at the customer’s risk.
  6. It is the responsibility of the purchaser to ensure that (A) Goods purchased are suitable for the purpose for which the ultimate user intends to use them. (B) The method by which the ultimate user proposes to fix the tiles is satisfactory for the purpose intended.
  7. No claims whatsoever will be accepted with regard to batch/shade variations, crazing or any other inherent characteristic of kiln-fired products.
  8. Sizes and weights quoted are approximated only, due to inherent nature of ceramic variation during manufacture cannot be avoided. The company may not be liable for any variation in size or weight of goods where such variation falls within accepted industry standards.
  9. It is the responsibility of the purchaser to check all goods on receipt. No claims will be accepted by Burleigh Tiles Pty Ltd for shortages breakages or tile imperfections unless made within seven days from date of purchase and lodged with Burleigh Tiles Pty Ltd at the registered office, any claim not made in accordance with this clause shall be deemed to be waived by the purchaser.
  10. No claims whatsoever will be accepted with regard to tile imperfections or shade variation once the tiles have been laid.
  11. It is the responsibility of the ultimate user to take due care while floor tiles having consideration of their fragile nature and no claims will be recognised for chipping or cracking of floor tiles after they have been laid.
  12. Any deposit paid by the purchaser is non refundable except with the agreement of the Company in its absolute discretion.
  13. All natural stone products sold or the understanding that it is a natural product and therefore sold with no guarantees whatsoever.
  14. No credit will be allowed for floor tiles that are epically in for customers.
  15. Goods will be accepted for return and credit unless the prior approval of Burleigh Tiles Pty Ltd has been obtained. If a credit is approved in accordance with this clause then a re-stocking and handling fee of 25% of the invoice value of the goods returned will be charged. Plus freight charge back to wholesaler.
  16. Burleigh Tiles Pty Ltd shall not be liable for any failure to perform, or delay in performance of the contract due to strikes, fires, floods, riots, labour difficulties, interruption of transportation, accidents, inability to obtain supplies, war, governmental action or other circumstances beyond the company’s control.
  17. Burleigh Tiles Pty Ltd cannot guarantee continuity of a product supply, for example if a supplier decides to discontinue a product.
